Work Permit for Student

Aggie Hoffman

I am from Mexico and have been here since age 5 and am now in high school. I have heard a lot in the news about work permits for students like me who have been here since early age. There are already advertisements from notarios and lawyers. When can I apply? What do I need to do? How long will it take for the process? The answer to your question is information that many must have. It is most important to understand that although the… [ Continue reading ]

DV Lottery

Aggie Hoffman

I am about to step into the US in next month on F-1 and I applied for the DV Lottery 2011 after I got the F-1 visa. My question is, will I face any difficulty at the port of entry? And if I win the lottery in next July will there be any problem to become an immigrant with my present status? Based on the sequence of the applications, there appears to be no conflict between the required non-immigrant intent (F-1) and application for the… [ Continue reading ]

F-1 Visa Expired

Aggie Hoffman

I’m currently in the Stated in F1 category. My visa expired July 2008. My I-20 is still valid until November 2011. I’m in good standing. I’m also applying for residency (I-485, I-130) and my case is being processed. I am granted I-131. My question is, if I travel back to my home country over this break, when I return to the States early February 2010, do I have to go to the US Embassy to apply for another F1-visa? Thanks for your help. A person… [ Continue reading ]

Withdraw Green Card Sponsorship

Aggie Hoffman

I’m a green card holder since two years now. I obtained my green card through my uncle (who had sponsored my father). Can my uncle withdraw his sponsorship and get our green cards revoked? In general, once resident status (green card) is issued based on an approved visa petition, the immigration process has been completed and the petitioner (your uncle) has no legal authority to revoke it. One exception may be in marriage cases where resident status is “conditional” and it is reported to immigration… [ Continue reading ]

City of Residence

Aggie Hoffman

The “City of residence where you applied for an immigrant visa or adjustments of status” — is this the city where I applied for the card? Or the city I lived in when I received my adjustment of status? It refers to the city of your residence, where you lived, when you filed your Application to Adjust Status (form I-485). Even if you moved after filing or after your interview and lived elsewhere when your resident card was issued or received, your residence at the… [ Continue reading ]

I have a friend and I want him to visit me for about 1 month. My question is: I will have been divorced by the time I file for his paperwork. My soon to be ex is from the same country. I will be taking back my maiden name too. My friend has done so much for me when I was in his country and I would love for him to visit me. What steps should I take? Do you think his chances are good… [ Continue reading ]

Unite My Family

Aggie Hoffman

I fell in love with a Mexican. I got pregnant and wanted to get married, but because of his past problems we were told that if we do, he could be sent back to Mexico. So we had 2 children (ages 3 and 1) without getting married. He was arrested for driving under the influence and sentenced to one year probation. In 2005, he got a letter from immigration court but did not appear. In Oct 2010, he was picked up by ICE and sent… [ Continue reading ]

Too Late for an Annulment?

Aggie Hoffman

I was in a relationship & fell in love with my boyfriend spring of ’07. Come summertime, he pressured me into marrying him because otherwise he would have to leave the country soon, as he was an immigrant. Because I loved him, we eloped. 8 months later I found out he had no intentions on being faithful and carried on several other relationships, one being with my best friend who eventually told me everything. I have not spoken to, or seen him for over a… [ Continue reading ]

Food Stamp Benefits

Aggie Hoffman

I’m an immigrant & I applied to get Food Stams Benefits for my daughter, who is a 5 year-old U.S. citizen. In the future can my U.S. residency or citizenship can be denied, because I appear as the applicant for my daughter’s benefits? It is not clear from your question whether you already are a U.S. lawful resident. However, if the public benefit you received is in the name of your U.S. citizen daughter and was not for you, it should not adversely impact your… [ Continue reading ]

Passport for Minor Daughter

Aggie Hoffman

I am a US Citizen who wants to apply for a passport for his 10 year-old daughter that just arrived to USA. I filled out Form DS-11 in order to get her passport but I now learned that I need the mother’s authorization in order for them to issue the passport for her. The mother lives abroad, so she cannot sign the form DS-3053 because it needs to be notarized by a notary in United States. Can I get a notarized authorization from my daughter’s… [ Continue reading ]
